In matter Intercontinental Enterprises, BALCA held that the employer must use the newspaper in the area most appropriate to the occupation in question and the workers likely to apply for the job opportunity and most likely to bring responses from able, willing, qualified, and available U.S. workers.
Generally speaking, the major newspaper with the highest circulation will be the correct choice.
Many employers are price sensitive (rightfully so) and opt for a smaller newspaper because it is less expensive. This is a mistake.
With this decision, BALCA and 20 C.F.R. § 656.17(e)(1)(i)(B)(1) make it clear that the employer must use the newspaper in the area most appropriate to the occupation in question and the workers likely to apply for the job opportunity and most likely to bring responses from able, willing, qualified, and available U.S. workers.
