Tuesday, August 15, 2000 - INS Will Not Process Any More FY00 Cases

INS informed AILA today that it began processing FY01 H-1B cap cases on Monday, August 7, 2000.
When INS began processing FY01 cases it completely closed out the FY00 year and will no longer process cases with starting dates before October 1, 2000.
This means that as INS was working with AILA to set up a mechanism to correct egregious errors by INS in processing H-1Bs for this fiscal year, the agency had already decided not to issue any additional FY00 numbers.
No FY00 H-1B visas are available for recapture, even in the case of egregious error by INS.
INS will process those error cases with October 1, 2000 dates.
AILA will continue to discuss with INS its counting methodology and its procedure of not recapturing revocations within the same fiscal year after the cap has been reached.
