The Chennai Consulate has begun posting petition numbers of preapproved cases on its web site, at http://www.sphynx.com/madrasus/h1bpreapprovals.html. Cases posted on this website are ready for visa adjudication, and the applicants may apply through the Consulate's drop-box, thus sparing a personal appearance.
If your employee's petition number is on the list, you may instruct him/her to send the application and that of his/her dependents by using the Consulate's drop-box procedures. The only documents required are the Beneficiary's (and family members') passport, demand drafts, application Form (OF-156) and I-797 approval notice. If applying for dependents, Beneficiarys will also need to submit a marriage certificate and the birth certificates of children.
If your petition number is not listed, the Beneficiary will need to apply at the Consulate in person.
The Consulate informs us that many factors go into determining whether a case is pre-approved. After receiving approved petitions from INS, two consular officers review each petition, checking for adequate documentation, the absence of fraud indicators, and standard job categories. If there are questions concerning any aspect of the petition, the applicant will need to appear in person at the Consulate for an interview. Otherwise, the petition number will be posted on the web site.
The Consulate advises that Beneficiarys should not take exclusion from the list as a negative indicator, and they urge Beneficiaries to avoid contacting the Consulate to inquire about this program. The Consulate's position is that either your number is on the list or it is not. Needless to say, the Consulate reserves all right to select these pre-approved cases and will not discuss individual cases.
