    The U.S. Department of Labor (DOL) published a proposed rule on 2/13/06 in the Federal Register in which:

    • The DOL proposes to eliminate the Labor Certification (LC) Substitution process.

    • The DOL plans to impose a short time frame of just 45 days for the employer to file the I-140 petition after the approval of the LC.

    • The DOL plans to eliminate the payment of certain fees to an employer by an employee in connection with the LC filing process.
